GENERAL SALE CONDITIONS
These general conditions concern the purchase of products, carried out remotely on the internet, from EDARCOM EUROPA Ltd, based in Via Macedonia 12, 00179 Rome. Each transaction is carried out pursuant to the provisions of the Legislative Decree 6 September 2005 no. 206 (Consumer Code) and, in particular, to those referred to in Section II, Part II, Title III (Distance contracts), as well as, with regard to data protection, to the provisions of Legislative Decree 30 June 2003, no. 196.
The contract is finalized when the EDARCOM EUROPA art gallery receives the purchase order for the selected products sent by the Customer via the www.edarcom.it website. The placing of the electronic purchase order implies full awareness on the part of the Customer of the General Sales Conditions and Terms of Payment set out in this contract, as well as their acceptance. The Customer accepts having viewed all information provided during the purchase process. In the case of the Customer being a consumer (i.e., a person who acts for purposes unrelated to entrepreneurial, commercial, artisanship or professional activities), an electronic copy of this contract must be printed out or saved once the purchase process is completed; this is also pursuant to Legislative Decree no. 206/2005 regarding distance contracts. The Customer does not have any right to be refunded for damages or compensation, nor any right regarding contractual or non-contractual liability for direct or indirect damages to persons and/or things, arising from the non-acceptance, even partial, of an order.
The purchase of products for sale on the www.edarcom.it website is agreed at the price indicated therein, which is confirmed when the order is made, in addition to any transport costs. Before the purchase is confirmed, the cost of each product selected, the transport costs and the total cost will be given.
Payment of the price of the products purchased and of transport costs must be made according to the method chosen at the time the purchase order is placed: BANK TRANSFER – CREDIT CARD – PAYPAL.
The delivery of the products will be carried out according to one of the following methods, depending on the customer’s wishes:
- The product(s) can be collected directly by the customer at the Edarcom Europe art gallery in Via Macedonia, 12 (Rome), free of charge.
- Home delivery by the Edarcom Europe art gallery to the address provided by the Customer (valid only for deliveries in the Lazio region of Italy).
- Express courier: delivery to the shipping address indicated by the customer.
The customer is required to verify that the package is intact, that it is dry and not damaged. The customer should accept delivery only after such verification. If the delivery is accepted and the contents of the package are found to be damaged, the customer has 24 hours from the time of delivery to contact the Edarcom Europa art gallery and request a refund that will be issued by the insurance company. Photographs in which the damage is clearly shown must be sent with the request.
All dates indicated in the terms of delivery on the website are purely indicative, and in no case should they be considered binding. However, the EDARCOM EUROPA art gallery will ensure that orders are dispatched as soon as possible, in accordance with the packaging and delivery times of the purchased products. The Company is not liable for any delays by national couriers due to external causes or force majeure. In this regard, the Customer declares that he has been informed that the delivery time for dispatching an order may vary, depending on the type of processing and the quantity of products required.
If the purchase order is made from a foreign country (EU or non-EU), the EDARCOM EUROPA art gallery will provide, free of charge, the self-certification for contemporary art issued by the Export Office of the Ministry of Cultural Heritage and Activities, i.e., the documentation necessary for the purchased artwork to travel beyond Italian national borders. This procedure can take from five to ten working days. The EDARCOM EUROPA art gallery will ship the artwork only after obtaining the permit issued by the Export Office.
You have the right to withdraw from the contract signed with the Seller, without any penalty and without specifying the reason, within ten (10) working days, starting from the day you receive the items purchased on the www.edarcom.it website. In order to exercise the right of withdrawal, the customer must send an email to info@edarcom.it and wait for the specific return form that will be sent to the Customer by email. Only when the customer has received the form will they be able to ship the item that they wish to return. Under no circumstances will returns be accepted if the Customer fails to make an explicit request or if the Company has not sent the return form to the Customer. The customer assumes the costs and risks relating to the transportation of the returned item. Once the returned item arrives at the EDARCOM EUROPA art gallery, Via Macedonia 12 – 00179 Rome, the company will issue the refund within ten working days.
The law courts of Rome shall have exclusive jurisdiction over any dispute relating to the interpretation or execution of this contract.
